The www.wingwars.ca website (hereinafter, the “Site”) is operated and hosted in Winnipeg, in the province of Manitoba, by Awesome Advertising Inc. (hereinafter, "Wing Wars"). By using the Site, the user agrees to be legally bound by the terms of use set out below, and to comply with all applicable laws and regulations (“Terms of Use”).

Specifically, by using the Site and/or when you send us personal information about yourself, you agree to have consented to such data being used and disclosed for such purposes and by the means described herein. If you are a user located outside Manitoba, and you provide information about yourself, you agree that your personal information is transferred and hosted in Manitoba and protected by the law in this province.

If the user refuses to accept all terms and conditions of the Terms of Use set forth herein, the user must immediately stop any and all access to this Site, stop viewing the contents of this Site, withdraw any and all requests for the services and/or products that are presented, and not send to Wing Wars any of your personal information.

The Terms of Use between the user and Wing Wars can only be changed by Wing Wars, in its sole discretion, upon reasonable notice by posting changes on the Site of Wing Wars. The Terms of Use, for an indefinite period, shall take effect at the time of entry of the user on to the Site.

GENERAL INFORMATION

This Site is the official website of Wing Wars. No other website claiming to represent Wing Wars is authorized and Wing Wars will not be liable in any manner whatsoever for such sites. The information contained in this Site is provided for informational purposes only. For more information about the products offered on this Site, please contact Wing Wars directly.

Wing Wars makes no warranty as to the longevity of the Site and reserves the right to terminate at any time in its sole discretion and without notice. Wing Wars can not be held responsible for any loss or inconvenience suffered by the termination of this site. Wing Wars reserves the right to deny access to this Site to you, or any user, at any time without notice and without providing any reason. Wing Wars can and shall control the use of this Site. The Site is available "as is" and can not be changed by the user.

PARTICIPATING RESTAURANTS

The present section applies uniquely to restaurants participating at the event organized by Wing Wars (the "Restaurant"), notwithstanding anything to the contrary.

The Restaurant, when registering with Wing Wars, providing information through the Site, and at all other times where divulgations are made to Wing Wars, agrees that all such information shared with Wing Wars shall be governed pursuant to these Terms of Use. The Restaurant agrees, and consents by these Terms of Use, that Wing Wars may use all such information, including Restaurant contact information and names of Restaurant contact persons, provided by the Restaurant to Wing Wars for publicity of Wing Wars events and the Site, as well as to and for the benefit of Wing Wars’s partners and/or sponsors, who may thus contact the Restaurant to share promotions.

At the Restaurant’s request, Wing Wars will remove the Restaurant’s information out of its database, and if requested, request same from its partners/sponsors’ database.

The payment of the registration fee is a condition of participation in any respective Wing Wars event. In light of the COVID-19 sanitary crisis, Wing Wars will offer a refund of half of the registration fee of a participating restaurant, if the government (whether municipal, provincial or federal, but having jurisdiction over the concerned restaurant) orders restaurants to be closed for the week of Wing Wars Week before January 20, 2021. After this date there will be no refund.

All terms and conditions applicable to “users” in this Terms of Use are also applicable to Restaurants.

This Site, and any and all content found on it, is protected by copyright. No user of this site may reproduce, copy, publish, transmit, communicate or use in any manner the material, information or trademarks contained in this site without the written consent of Wing Wars.

Retransmission, copying, use, reproduction, distribution or publication of the content whether a photograph, audio or video documents, in whole or in part is prohibited without the prior written permission of Wing Wars, otherwise the user could be exposed to legal liability and proceedings.

The names of companies, products, services and logos contained in www.wingwars.ca may be trademarks or registered trademarks of their respective owners and are protected accordingly. It is forbidden to use any trademark displayed on this website without the prior written permission of Wing Wars or copyright holder of the trademark.

The user and/or Restaurant agrees that any legal proceeding in relation to Wing Wars, a Wing Wars event, this Site, or any and all information shared by the user and/or Restaurant with Wing Wars, shall be filed in the forum/jurisdiction of Manitoba in the Centre of Winnipeg.

The non-exercise by Wing Wars of its rights shall in no way constitute a waiver for the future of this law or any provision of this Terms of Use.

SEVERABILITY

Invalidation of any provision of this Terms of Use shall not affect the validity of all other provisions. The invalid provision(s) shall be severable from the entire Terms of Use without affecting the content.

REMEDY

The user acknowledges and agrees that Wing Wars, its officers, directors, employees and agents shall in no case be sued, prosecuted, or have any liability whatsoever in connection with the use of this site by the user and no compensation shall ever be granted or awarded from Wing Wars to the user in any forum or jurisdiction. The user who navigates the Wing Wars website does so because of its own choice.

In addition, the user agrees to indemnify Wing Wars, the officers, directors or employees for any misuse of this site or any contravention of these rules and guidelines by the user. USER ACCOUNT

To participate in certain activities of Wing Wars, the user is required to provide certain information that entitles them to a user account. This user account is used to identify a single user, particularly in relation to its participation in the contest Wing Wars and/or on the WINGWARS.CA site.

The WINGWARS.CA site allows users to create a user account and use it to vote for their favorite Wings.

The online user account and its user may utilize the WINGWARS.CA site at the the sole discretion of Wing Wars. If, for example, a user uses the voting system of the competition unduly, the user account will be deleted unilaterally and/or blocked from the WINGWARS.CA site and their votes canceled at the sole discretion of Wing Wars.

The use of good faith implementation of the WINGWARS.CA system, Privacy Policy, and Terms of Use is required.

IP ADDRESS

Wing Wars uses the IP address of a person in order to identify the address, gather demographic information about site users, diagnose problems with the electronic systems of Wing Wars and manage websites.

OPTION TO WITHDRAW

As provided in this Agreement, individuals have the option (i) to refuse communications from Wing Wars, (ii) remove their personal information records at Wing Wars, or (iii) not to receive services from Wing Wars. If an individual does not wish to receive further communications, it is requested to contact us by referring to the contact information below.
